TERMS AND CONDITIONS

Pastry Leidy LLC — Terms & Conditions

1. General Agreement

By placing an order with Pastry Leidy LLC or via pastryleidy.com, you agree to the following Terms and Conditions. These terms may be modified and updated periodically.

2. Michigan Cottage Food Declaration

All products are prepared in a home kitchen operation in accordance with Michigan Cottage Food Law (MCL 289.4102). Products are made in a home kitchen that has not been inspected by the Michigan Department of Agriculture and Rural Development (MDARD). All recipes are non-potentially hazardous and shelf-stable at room temperature.

3. Allergen & Cross-Contamination Notice

Our home kitchen handles major food allergens including MILK, EGGS, WHEAT, SOY, PEANUTS, and TREE NUTS. While strict sanitation protocols are followed, we cannot guarantee an environment 100% free of cross-contamination. The customer assumes full responsibility for informing their guests of potential allergens.

4. Guarantee & Payment

  • Full Payment: Full payment is required to reserve and secure all custom order dates on our calendar. Your date is not reserved until payment is received in full.

  • Invoice Accuracy: It is the customer's responsibility to review invoice details (date, time, flavor, spelling, and design details) and notify us immediately of any errors.

5. Cancellation & Refund Policy

Because all orders are custom-designed and perishable, we follow a strict cancellation schedule:

  • Wedding & Large Cakes (50+ Servings):

    • Cancellations made more than 30 days before pickup: 50% refund.

    • Cancellations made within 30 days of pickup: Non-refundable.

  • Standard Custom Cakes (Under 50 Servings) & Cupcakes:

    • Cancellations made more than 15 days before pickup: 50% refund.

    • Cancellations made within 15 days of pickup: Non-refundable.

6. Scheduled Pickups, Rescheduling & No-Shows

  • Strict Scheduling: Pickup dates and times are scheduled in advance to manage production and workshop space. Customers must arrive within their agreed-upon pickup time window.

  • Rescheduling Requests: If you need to change your pickup date or time, you must notify Pastry Leidy LLC as early as possible. Rescheduling is strictly subject to calendar availability—we cannot guarantee an alternative slot will be open.

  • Missed Slots & Customer Responsibility: If you miss your scheduled time slot and Pastry Leidy LLC has no alternative openings available to accommodate you, the order is the customer's responsibility. Unclaimed orders where no alternative time can be scheduled will be forfeited without refund.

  • Holding & Discarding Policy: Due to limited storage space, unclaimed cakes will be discarded at closing time (5:00 PM Mon–Fri / 12:00 PM Sat). We do not hold unclaimed orders for next-day pickup.

7. Order Modifications

  • Wedding / Large Orders: Design, flavor, or size changes require at least 30 days' notice.

  • Standard Orders: Changes require at least 72 hours' notice.

  • Price Adjustments: Modifications may incur additional cost, which must be paid before changes are finalized.

8. Pickup Location & Hours

  • Location: Pickups take place at our home workshop in the Creston Neighborhood, Grand Rapids, MI. Exact address details are provided upon order confirmation.

  • Pickup Hours:

    • Monday – Friday: 10:00 AM – 5:00 PM

    • Saturday: 10:00 AM – 12:00 PM

    • Sunday: Closed (Pickup by prior written agreement only)

9. Cake Transportation & Customer Liability

  • Transport Conditions: Cakes must be transported on a flat, level surface in your vehicle (such as the passenger floorboard) with the Air Conditioning running. Do not transport cakes on tilted car seats.

  • Storage & Handling: Our recipes are shelf-stable at room temperature. Optional chilling in its sealed box prior to transit is recommended strictly to keep detailed buttercream work firm during warm weather. Keep away from direct heat and sunlight.

  • Internal Supports: Tiered or structured cakes contain non-edible internal supports (wooden dowels, plastic straws, or floral wire). These must be removed prior to cutting and serving.

  • Liability Hand-Off: Once a cake is handed over to the customer or their representative, it is accepted in its current condition. Pastry Leidy LLC is not liable for any melting, deformation, or damage occurring during customer transport, handling, or event setup.

10. Cancellation by Pastry Leidy LLC & Force Majeure

We reserve the right to refuse service or cancel an order due to unforeseen emergencies, extreme weather, or illness. In the rare event that Pastry Leidy LLC must cancel your order, a 100% full refund will be issued immediately. Liability is limited strictly to the total amount paid by the customer.

11. Website Use, Payments & Intellectual Property

  • Online Payment Processing: Online orders placed via our Wix storefront are processed securely through third-party payment gateways. Pastry Leidy LLC does not store or have direct access to your full credit card details. By submitting payment online, you represent that you are authorized to use the payment method provided.

  • Electronic Confirmations: Placing an order through our storefront generates an automated electronic order confirmation acknowledging receipt of your request. Final fulfillment remains subject to full payment verification and calendar schedule availability.

  • Intellectual Property: All text, photos, cake design images, logos, and branding displayed on pastryleidy.com are the property of Pastry Leidy LLC and may not be reproduced, copied, or used without prior written consent.
